California Changes Bail law
Recently, California has overturned its cash-based bail system. The bill has ordered courts to determine who gets out of jail and who doesn’t based on a new “risk-based” system.
The intent of the new bill is to ensure that those who are arrested are no longer subjected to financial inequalities that are apparent throughout the bail system. It is meant to “look at people as people”, as said by Sen. Bob Hertzberg.
However, opposers of the bill are worried that this could create an even more unfair and unequal system. Naturally, the new bill could significantly impact bail bond agents across the state. It can be expected that this industry will not go down quietly, and we can ensure you that we are doing our best to remain one of the most reliable agencies in Bakersfield California.
The Current Law
When someone is arrested, they typically have the right to post bail. This allows for the person who was arrested to be released from jail while waiting for their court dates. It is our job to assist with this process, asking for 10% of the posted bail in exchange for releasing the person in jail. Sometimes instead of money, property can be used for collateral but this is much less common.
Can everyone post bail?
The simple answer is no. If a person has committed a capital crime, such as homicide, a felony involving violence or sex, or if the judge determines their release could cause harm to themselves or others, then they are not eligible for bail.
What will this new bill do?
Cash payment is eliminated and a new “risk system” is in place, which will be used locally to determine whether the defendant in question is likely to voluntarily attend their court hearings and other legal obligations. The system will also evaluate the likelihood of the defendant being re-arrested.
Who will conduct these evaluations?
Counties plan to put agencies in place to evaluate defendants. Those determined “low” risk will be granted bail while those who are determined “high” risk will be kept in holding.
Those who fall in the middle, or “medium” risk will be either put up for bail and held based on the local decision.
When will this bill be in effect?
Although information has been released this past summer, the bill will be in effect as of October 2019, giving Bail Bond agencies a little bit of time to set it straight.
